I highly doubt Buds would "Try" and pass it off as "New"! Once that firearm is transferred and fired, it has in fact been "Used". For a direct answer though, I'd give Buds Customer Service a call at 1-859-368-0371 9am-7pm EST Mon-Fri and ask them Directly.

Hi Humberto and welcome. No, any factory new firearm that is "Transferred" to a buyer through form 4473 is considered "Used" at that point and is not legally eligible to ever be resold as "New". Cheers, stay safe and enjoy!
