Yes, if the gun you want to buy is Legal itself in your state. Bud's will simply remove the non-compliant magazines and leave it up to the buyer to purchase their necessary state compliant magazines.

Yes it can. It just won't have the 10+ round mags shipped with the firearm. You'll have to find state compliant magazines on your own.
