Looks like just the latch. Buds will accept a return. But rules state manufacture package must not be open. Return must be within 10day. They ask that you pay return shipping and a possible 10% restocking fee. However since the add was mildy deceptive, you may be able to get all fees waived (possibly, no promise), by calling 1-859-368-0371 and explaining the situation to a Buds sales rep. Good luck, I hope they take care of you.
