It is considered a pistol because of the stabilizing brace in lieu of a stock.

Karina, this is a pistol. This has a 8 inch barrel and a pistol brace. Rifles have a 16 inch barrel or longer and a stock. In order to be a pistol it must have under a 16 inch barrel. Once the barrel hits 16 inches it is then considered a rifle. If this had a stock instead of a pistol brace it would then be a short barreled rifle and require a $200 tax stamp. Hope this helps.

Katrina, it is a standard Pistol/Handgun as configured Ma'am. A firearm with a barrel less than 16 inches but has a Brace instead of an actual Shoulder Stock is considered a Handgun/Pistol. If said firearm has a barrel less than 16 inches and a Shoulder Stock is considered an SBR (Short Barreled Rifle) and would need to be NFA registered and a $200 Tax Stamp paid. Cheers and stay safe!
