While apparently common what are my options if my BG check is delayed. It has been nearly 3 weeks. If it continues to be delayed can I have the FFL return the items for a refund? I understand the appeal process for the NICS and wold work that angle, but should I then be denied what is the impact to my now useless purchase?

Edward, your FFL should be aware of Federal Laws regarding a "Delayed" NICS Background Check. There is a time period during the delay that they can legally transfer the firearm to you.  Info here  :  https://www.fbi.gov/services/cjis/nics/a-nics-delay
