I bought shotgun as gift, should I have my buddy, who the gift is for fill out nics and pick it up? I did not even think of gift card.

SEE ***** You will have to pick up from the FFL and do the paperwork for the shotgun unfortunately. Then you will have to transfer it to your buddy. You can confirm with Buds customer service (859) 368-0371 9am-9pm mon-fri or use the blue Chat Now button. In Most states you can just give it to him with no paperwork requirement however I would do something like a bill of sale and you each keep a copy for an down the road issues. or you could take him to a FFL (after you do your paperwork on the gun) and then have them transfer it to him You are the Purchaser of the firearm until you pass it on to him "In the United States, a straw purchaser of a firearm at a federally licensed firearm dealership who lies about the identity of the ultimate possessor of the gun can be charged with making false statements on a federal Firearms Transaction Record.******* If a firearm is purchased as a gift, the transaction is not a straw purchase, and the person buying the gift is considered the end user*******. It is illegal for any person not in possession of a Federal Firearms License to purchase a firearm with the intention of resale. Private purchases in lawful sales made outside of federally regulated dealerships are not subject to such rules and are legal unless the gun is used in a crime with the prior knowledge of the straw purchaser."
Guy, in this case, you are required to fill out the NICS as the actual purchaser. This absolves the appearance of a "Straw Purchase" even though we know it is not. The name on the purchase invoice will be who the FFL will transfer this firearm to. Yes, a gift card in the full purchase amount would have been easier all said and done.

Based on the law, if our buddy is NOT a blood relative he should fill out the NICS paperwork even thought it is a gift. If you filled out the paperwork it's considered a straw purchase & you will have also lied on the 4473 in the check box affirming you are the purchaser. The 4473 purchaser check box is not intended to indicate you purchased the firearm to give to someone else. In the strictest sense; it means you are the purchaser and owner of the firearm.
