  • i live in Maryland and If you google maximum capacity of a mag it says it is illegal to purchase, sell or manufacture magazines with a capacity of greater than 10 rounds within Maryland. However, possession of magazines greater than 10 rounds is legal if purchased out of state. i checked with my FFL dealer and he said we are good to ship he also called the state police office and they said its OK so why wont the dealer i'm purchasing the gun fro ship the mag that comes with it ?????

  • because most online dealers will not do anything that may cost them their license. and unless it is cut and dry in writing they will error on the side of caution. Also is the gun on the MD authorized list https://licensingportal.mdsp.maryland.gov/MSPBridgeClient/#/home
    the other issue is that since the local FFL is doing the paperwork is that as far as BATF is concerned you are BUYING the gun in MD not in KY.

  • Richard, those rules apply to just the magazine and not the magazine with the handgun. The handgun is the key to this whole situation. Your local FFL and State Police should know that by Federal Law a handgun cannot be purchased by a non resident outside your State of residence. Yeah, you paid for it but, you do not own it yet. It is then transferred to you by your local MD FFL who is licensed to sell firearms where? In Maryland. In the case of firearms, paying for it at an out of State retailer is not owning it until it is transferred to you by your MD FFL. An out of State FFL logs the firearm out of their inventory, sends it to your local FFL who logs it into their inventory and finally transfers it to you at which time you become the actual owner. This is why Buds states that a firearm must be State compliant as it comes from the factory. 10rd magazines and all. Cheers and stay safe!

  • Richard, Because MD has bogus laws that make it illegal for retailers to sell standard capacity magazines to MD residents in MD. When it is shipped to your home it is not purchased out of state. You receive it in your state. You have to physically travel out of state to make your purchase.

    I suggest you have your FFL dealer and the seller try and work it out. The seller may not be aware of the out of state purchase being allowed.
