1) How can I tell if this is an new upgraded pico or a new first gen pico? The photo is first gen, but that may not be the pistol being sold.
2) If I get the gun to my local FFL, can I refuse delivery if it is not the upgraded one?

Bob, you can refuse transfer for anything not to your liking for a suitable replacement or refund(Buds policy).
