BudsGunShop.com - Requirements to gift my son a firearm
-
-
I live in NC and my son lives in KY. He has no criminal record (if he does he better hope I don't find out) and I'd like to give him a XD-M as a present. KY requires no permit to purchase a firearm and no background check for private gun sales. Is there anything I need to do prior to gifting this firearm to him? Thanks for any info you can provide.

Michael, Under federal law, an individual is prohibited from transferring a firearm to an individual who does not reside in the same state as the transferee. Generally, for a person to lawfully transfer a firearm to a person who resides out of state, the firearm must be shipped to an FFL within the recipient’s state of residence. He or she may then receive the firearm from the FFL upon completion of an ATF Form 4473 and a NICS background check. You may be better off just giving him the money (or a gift card) and let him make the actual purchase.
