  • i purchased a CZ SCORPION EVO 3 S1 with a muzzle brake with a 16" barrel last Jan 2022, now the gun brace rule is confusing to me. I would like to know if this weapon now has become an SBR.

  • Anthony, sounds like you bought the EVO 3 S1 carbine, which is a rifle. The ATF's new ruling only affects pistols, not rifles. You bought your gun as a rifle, it is still a rifle. The ruling has no effect on you. It would need a barrel shorter than 16" to be an SBR.

  • Anthony, no, since the CZ SCORPION EVO 3 S1 has a 16 inch barrel it's considered a rifle and can have a stock or brace on it legally without a tax stamp. Only firearms that are subject to the new rule is pistols, so firearms with a Barrel length less than 16 inches and have a pistol brace on them. Since yours has a 16 inch barrel it's considered a rifle and not a SBR/short barreled rifle. So no need to be worried, you're good to go. Hope this helps.

  • If your firearm has a 16" or longer barrel then the changing rules regarding braces will not affect you. Braces were formerly allowed to be used on pistols without changing the firearm's classification, though now their use on a firearm with a barrel shorter than 16" is considered to render the firearm an SBR. If your firearm was not a pistol to begin with, nothing changes. Based on your description I'm assuming you have something like Model #08505 here: budsgunshop.com/product_info.php/products_id/4215/cz+scorpion+evo+3+s1+carbine+w+muzzle+brake+20rd in which case you would not need to worry about the brace rule.

  • Hi Anthony, no Sir. Because it has a 16 inch barrel it is legally a rifle (not short barreled). A stock or brace would not change the classification. If less than a 16 barrel then it would be a SBR and NFA rules would apply. Cheers and stay safe!
